Dans un rapport publi\u00e9 ce mois-ci, l\u2019organisation Ius Stella d\u00e9nonce les cons\u00e9quences alarmantes de l\u2019op\u00e9ration Ndobo, lanc\u00e9e en d\u00e9cembre 2024 par le Minist\u00e8re de l\u2019Int\u00e9rieur congolais. Officiellement destin\u00e9e \u00e0 lutter contre la criminalit\u00e9 urbaine et le ph\u00e9nom\u00e8ne dit \u00ab Kulunas \u00bb, cette op\u00e9ration s\u2019est rapidement transform\u00e9e en une campagne d\u2019arrestations massives, ciblant particuli\u00e8rement les jeunes en situation de rue, y compris des mineurs.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Depuis la lev\u00e9e du moratoire sur la peine de mort en mars 2024, la R\u00e9publique D\u00e9mocratique du Congo a renou\u00e9 avec des pratiques d\u2019une extr\u00eame gravit\u00e9 qui bafouent les principes les plus fondamentaux de justice. Le rapport de Ius Stella met en lumi\u00e8re des violations syst\u00e9matiques du droit \u00e0 un proc\u00e8s \u00e9quitable: le jugement de civils par des juridictions militaires, l\u2019absence de repr\u00e9sentation l\u00e9gale, les condamnations collectives, la manipulation de l\u2019\u00e2ge des mineurs, et le transfert de d\u00e9tenus dans des prisons \u00e9loign\u00e9es avant leur jugement d\u00e9finitif.<\/p>\n

Plusieurs cas document\u00e9s dans le rapport illustrent cette d\u00e9rive, notamment celui de Dieumerci Ndombasi Kiala, choriste arr\u00eat\u00e9 en d\u00e9cembre 2024 sans motif apparent et jug\u00e9 sans avocat en cinq jours. Il a \u00e9t\u00e9 transf\u00e9r\u00e9 \u00e0 la prison militaire d\u2019Angenga, dans la province de la Mongala, o\u00f9 les conditions de d\u00e9tention mettent sa vie en danger. Un autre exemple est celui de Samuel, 17 ans, orphelin vivant dans la rue, arr\u00eat\u00e9 pour \u201cvagabondage\u201d puis accus\u00e9 de \u201cterrorisme\u201d sans preuve. Il n\u2019a \u00e9t\u00e9 acquitt\u00e9 qu\u2019apr\u00e8s l\u2019intervention de l\u2019avocat mis \u00e0 sa disposition par l\u2019ONG \u00ab Les Anges Ecoliers \u00bb dont il suivait le programme de r\u00e9insertion.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Tous les d\u00e9tenus, y compris ceux non condamn\u00e9s \u00e0 mort, subissent des conditions de d\u00e9tention d\u00e9gradantes : surpopulation, absence de nourriture, d\u2019eau potable et de soins m\u00e9dicaux, violences, isolement total. Certains, bien que non condamn\u00e9s \u00e0 mort, risquent de mourir en d\u00e9tention. Cette situation \u00e9quivaudrait, dans les faits, \u00e0 des ex\u00e9cutions extrajudiciaires.<\/p>\n

Ius Stella appelle les autorit\u00e9s congolaises \u00e0 suspendre imm\u00e9diatement toutes les ex\u00e9cutions pr\u00e9vues, \u00e0 r\u00e9examiner les condamnations prononc\u00e9es dans le cadre de l\u2019op\u00e9ration \u00ab Ndobo \u00bb, et \u00e0 garantir un acc\u00e8s effectif \u00e0 une d\u00e9fense pour tous les d\u00e9tenus. L\u2019organisation demande \u00e9galement l\u2019am\u00e9lioration urgente des conditions de d\u00e9tention et une protection renforc\u00e9e pour les mineurs, conform\u00e9ment aux obligations nationales et internationales de la R\u00e9publique D\u00e9mocratique du Congo.<\/p>\n

In a report released this month, the organization Ius Stella denounces the alarming consequences of Operation Ndobo, launched in December 2024 by the Congolese Ministry of the Interior. Officially aimed at combating urban crime and the so-called \u201cKuluna\u201d phenomenon, the operation quickly turned into a campaign of mass arrests, disproportionately targeting street-involved youth, including minors. Since the lifting of the moratorium on executions in March 2024, the Democratic Republic of Congo has returned to practices of extreme gravity, undermining the most fundamental principles of justice. Ius Stella’s report highlights systematic violations of the right to a fair trial: civilians tried before military courts, lack of legal representation, collective sentencing, manipulation of minors\u2019 ages, and the transfer of detainees to remote prisons before final judgment. Several documented cases in the report illustrate this downward spiral, including that of Dieumerci Ndombasi Kiala, a choir singer arrested in December 2024 without apparent cause and tried without legal counsel within five days. He was transferred to Angenga military prison in the Mongala province, where detention conditions now threaten his life. Another case is that of Samuel, a 17-year-old orphan living on the streets, arrested for \u201cvagrancy\u201d and later charged with \u201cterrorism\u201d without evidence. He was only acquitted after the intervention of a lawyer appointed by the NGO \u201cLes Anges \u00c9coliers\u201d, whose reintegration program he was enrolled in. All detainees, including those not sentenced to death, are being held in inhuman and degrading conditions: extreme overcrowding, lack of food, drinking water, and medical care, exposure to violence, and complete isolation. Some, although not formally sentenced to death, may die in detention. This situation would amount to extrajudicial executions. Ius Stella urgently calls on the Congolese authorities to immediately suspend all scheduled executions, to review all convictions handed down under Operation Ndobo, and to ensure that all detainees have effective access to legal defense. The organization also urges urgent improvements in detention conditions and strengthened protections for minors, in line with the Democratic Republic of Congo\u2019s national and international obligations.
