Je refuse de rester spectatrice pendant que d'autres familles sont d\u00e9chir\u00e9es par un syst\u00e8me judiciaire qui a perdu son humanit\u00e9. Le syst\u00e8me en RDC est peut-\u00eatre gangren\u00e9 par la corruption et les dysfonctionnements, mais il n\u2019est pas irr\u00e9formable. Nous devons exiger des comptes de l\u2019\u00c9tat, faire en sorte que les citoyens connaissent leurs droits, et d\u00e9coloniser les structures qui continuent d\u2019opprimer des millions de d\u00e9gradant qu\u2019elles infligent aux personnes d\u00e9tenues: surpopulation extr\u00eame, nourriture insuffisante, violences physiques...<\/p><p>De septembre 2020 \u00e0 d\u00e9cembre 2022, nous avons men\u00e9 le projet \u00ab Dignit\u00e9 &amp; Justice pour Tous \u00bb \u00e0 la prison centrale de Makala, principal \u00e9tablissement p\u00e9nitentiaire de Kinshasa o\u00f9 la surpopulation carc\u00e9rale a entra\u00een\u00e9 de nombreux d\u00e9c\u00e8s.<\/p><p>Construit en 1957 sous la colonisation belge, la prison avait \u00e9t\u00e9 con\u00e7ue pour accueillir 1500 prisonniers.<\/p><p>Au d\u00e9but de l\u2019ann\u00e9e 2024, elle en h\u00e9bergeait plus de 15 000, soit un taux d\u2019occupation d\u00e9passant les 1000%.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5dc007d elementor-widget__width-initial elementor-widget-tablet__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"5dc007d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Notre \u00e9quipe agissait dans trois cat\u00e9gories de dossiers :<\/p><ul><li><b>Le d\u00e9passement de peine :<\/b> De nombreux prisonniers restent incarc\u00e9r\u00e9s plusieurs ann\u00e9es apr\u00e8s leur date de sortie pr\u00e9vue.<\/li><li><b>La d\u00e9tention sans aucun acte de proc\u00e9dure :<\/b> Les cas de d\u00e9tention pr\u00e9ventive qui exc\u00e8dent le d\u00e9lai l\u00e9gal de 15 jours. Certains prisonniers sont priv\u00e9s de libert\u00e9 durant des mois, voire des ann\u00e9es, sans acte de proc\u00e9dure justifiant leur d\u00e9tention.<\/li><li><b>Les dossiers \u00ab oubli\u00e9s \u00bb :<\/b> Les dossiers dont l\u2019instruction n\u2019a jamais \u00e9t\u00e9 cl\u00f4tur\u00e9e. Parfois, l\u2019affaire a \u00e9t\u00e9 mise en d\u00e9lib\u00e9r\u00e9 mais aucune suite n\u2019a \u00e9t\u00e9 donn\u00e9e pendant plusieurs mois o. Mission Statement We are redefining justice as a tool for empowerment and social cohesion by expanding access to legal aid, leveraging people-centered data, and advocating for restoration rather than punishment. Our history Prisons in the DRC are notorious for the inhumane and degrading treatment of detainees, including overcrowded cells, insufficient food, and physical violence. From September 2020 to December 2022, we ran the &#8220;Dignity &amp; Justice for All&#8221; project at Makala Central Prison, the main penitentiary facility in Kinshasa, where overcrowding has resulted in numerous deaths. Makala was built in 1957 during Belgian colonial rule to accommodate 1,500 prisoners. At its peak in early 2024, it housed more than 15,000 individuals\u2014an occupancy rate of over 1,000%. Our team worked on three main categories of cases: Sentence overrun: Many prisoners remain incarcerated for several years after their scheduled release date. Detention without due process: Cases of pretrial detention that exceed the maximum legal duration. Some detainees are deprived of their liberty for months \u2014 even years \u2014 without any procedural act justifying their detention. Forgotten cases: Cases where the investigation was never closed. In some instances, the case was deliberated, but no judgment was ever issued. In other instances, the defendants&#8217; files were simply lost by the courts. Seeds of change The impact of our pilot project Liberate We provided legal and administrative support to 2,369 detainees facing serious judicial irregularities, such as prolonged detention beyond the end of their sentence, detention without due legal process, or lost case files. This support led to the release of over 400 individuals. Care We offered essential humanitarian aid to the most vulnerable detainees. We delivered 1,903 medical kits to the prison infirmary and distributed meals to 1,460 detainees, ensuring access to basic care and nutrition in an environment where both are dangerously lacking. Educate We supported the social reintegration of incarcerated youth by launching vocational training inside the juvenile wing of Makala Prison. Between February and October 2022, 50 minors received training in basic computer skills, preparing them for life after detention. Reform We published a comprehensive policy report calling for concrete reforms to end arbitrary and abusive detention practices in the Congolese justice system.
